Terms and Conditions of Use for The Mamascape Retreats, LLC

NOTICE: These Terms and Conditions of Use (“Terms”) are legally binding. It is your responsibility to read these Terms carefully prior to purchase, use, or access of any of our products or services, including retreats and online offerings.
1) Terms of Site & Offering Access; Purchaser Agreement
All programs, products, retreats, digital downloads, and services are owned and provided by The Mamascape Retreats LLC (“Company,” “we,” “us,” or “our”). “You” or “your” refers to any user or purchaser of our offerings (each, an “Offering”). These Terms govern your access to and use of our website(s), social media channels, and Offerings. We may update these Terms at any time by posting a revised version with the “Last Updated” date above. Continued use constitutes acceptance.
If you do not agree with these Terms, email hello@themamascape.com and we will make reasonable efforts to remove your account and access to our Offerings.
2) General Provisions
This website is owned and operated by The Mamascape Retreats LLC, an Arizona limited liability company. Use of this website is at your own risk. While we host our site on reputable platforms and take reasonable steps to maintain it, we make no warranties as to uninterrupted, error-free, or risk-free use. These Terms may change at any time.
3) Your Use; Eligibility; Consent
You must be 18 years or older (or the age of majority in your jurisdiction) to purchase or access our Offerings. Access by a minor is a violation of these Terms, and we may terminate access if discovered.
By purchasing or accessing any Offering, and by continuing to use our website or materials, you indicate your ongoing agreement to these Terms, our Privacy Policy, and any disclaimers or policies referenced here.
4) Intellectual Property Notice
All images, text, designs, graphics, videos, trademarks, service marks, and trade dress are owned by or properly licensed to The Mamascape LLC (collectively, “Intellectual Property”). You may not copy, reproduce, modify, republish, upload, post, transmit, translate, sell, create derivative works from, exploit, or distribute any Intellectual Property without prior written permission.
Limited, proper attribution to public blog content is permitted with a clear, conspicuous link back to the original page. You may not claim our Intellectual Property as your own, even with attribution. Third-party materials within our Offerings remain the property of their respective owners.
Online Course / Digital Content – Limited License
For any paid or free materials you access, we grant you a limited, non-transferable, non-exclusive, revocable license for personal, non-commercial use only, conditioned on compliance with these Terms.
You may:
Access the Offering for your personal use.
Download/print materials for your personal use.
You may not:
Resell, share, or transfer your access or materials.
Reproduce, distribute, or publicly display our materials.
Alter, edit, remix, or create derivative works for distribution.
Use our names, logos, or marks without prior written consent.
Use the Offering or materials for unlawful purposes.

5) Image / Testimonial Release (Optional Contributions)
If you voluntarily submit photos, testimonials, reviews, recordings, or similar content, you represent and warrant you own or control the rights to such content and you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, and display it for legitimate business purposes, including marketing. We are not obligated to notify you of each use.
6) Security; Assumption of Risk; Confidentiality
Security: You are responsible for safeguarding your login credentials. We do not store full payment card numbers; payments are processed by third-party processors (e.g., WeTravel, Stripe, etc.) under their terms and privacy policies. By using those processors, you assume any associated risks and agree to be bound by their terms.
Assumption of Risk: By using our website or Offerings (paid or unpaid), you assume all risks related to your participation and subsequent actions.
Confidentiality: Unless otherwise expressly agreed in writing, communications with us are not privileged or confidential. See our Privacy Policy for data practices.
7) Retreat-Specific Terms (In-Person & Virtual)
Bookings; Payments
Retreat bookings and related payments are processed through WeTravel and/or other listed processors. Your booking is subject to those platforms’ terms, payment schedules, and cancellation/refund policies, which will control in the event of conflict.
We reserve the right to update retreat details (location, schedule, inclusions) as needed.
Cancellations; Transfers
All cancellation, transfer, or refund requests must comply with the applicable WeTravel or checkout policy shown at booking. Certain fees may be non-refundable.
We recommend you purchase comprehensive travel insurance (including trip cancellation/interruption and medical coverage). You are solely responsible for understanding your policy.
Health & Wellness Disclaimer
Our retreats and virtual offerings provide educational and wellness experiences only. We do not provide medical, mental health, psychological, or nutrition counseling. Always consult your licensed healthcare provider before any wellness activity. Participation is voluntary and at your own discretion. If you are pregnant or postpartum, obtain medical clearance before engaging in activities.
Conduct; Removal
We foster a safe, respectful environment. We may remove or refuse service to any attendee who engages in harassing, unsafe, disruptive, or illegal conduct, without refund, to protect the group and staff.
Rooming & Property Rules
We aim to provide each participant their own bed unless expressly stated otherwise. You agree to comply with property rules (e.g., quiet hours, occupancy limits, no smoking, no unauthorized guests). You are responsible for property damage you cause.
Force Majeure
We are not liable for delay, rescheduling, modification, or cancellation due to events beyond our reasonable control, including acts of God, severe weather, illness, labor disputes, power failures, government orders, public health emergencies, or transportation disruption. Where feasible, we will reasonably seek alternatives; refunds and credits (if any) will follow the applicable booking policy.
8) Your Communications & Submissions
Communications made through our contact forms, email, social media, blog comments, or similar channels are not confidential and may be viewed by third parties. We may republish submissions, in whole or part, consistent with these Terms and our Privacy Policy. Do not submit illegal, defamatory, obscene, abusive, or otherwise inappropriate content.
9) Disclaimers
Our website and Offerings are provided for informational and educational purposes only. We do not guarantee any particular results or outcomes. While we strive for accuracy, materials may not be complete, current, or error-free. You are responsible for how you use the information.
If you require medical, legal, tax, or financial advice, consult a licensed professional. We expressly disclaim responsibility for actions or omissions you take based on our materials.
Earnings / Results Disclaimer
Testimonials or case studies do not guarantee results. Each person’s circumstances differ; we make no promises of specific results, earnings, or improvements.

We do not warrant that the website, Offerings, or materials will be uninterrupted, secure, current, or error-free, that defects will be corrected, or that they are free of viruses or other harmful components.
12) Indemnification; Limitation of Liability; Release
Indemnification
You agree to indemnify, defend, and hold harmless The Mamascape LLC and its owners, officers, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the website or Offerings; (b) your breach of these Terms; (c) your violation of any law or the rights of a third party; or (d) your negligent or wrongful conduct.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR PERSONAL INJURY), EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE WEBSITE OR OFFERINGS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC OFFERING GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100), WHICHEVER IS GREATER.
YOU AGREE ANY CAUSE OF ACTION MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CLAIM ACCRUES OR IT IS PERMANENTLY BARRED.
13) Financial Terms
Pricing; Taxes
Prices are listed at checkout and may change without notice. You are responsible for any applicable taxes, fees, or currency charges.
Refunds; Chargebacks
Refunds for retreats, courses, or other Offerings are governed by the specific policy shown at checkout (including any WeTravel policy). If a payment plan is provided and you do not cancel within the stated refund window, you must complete all remaining payments. Before initiating any chargeback, you agree to email hello@themamascape.com to request support. We reserve the right to provide evidence of access and applicable policies in any dispute.
Recurring Payments
If you enroll in a payment plan or subscription, you authorize us (and/or our processors) to charge your payment method automatically until the plan or subscription ends or is canceled per the applicable terms.
Revocation of Access; Collections
We may revoke access to any Offering for nonpayment or breach. Any unpaid amounts may be sent to collections, and you agree to be responsible for reasonable collection costs, including attorneys’ fees and court costs.
14) Termination
We may terminate or suspend your access to the website or any Offering at any time, with or without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account by emailing hello@themamascape.com; termination does not relieve you of payment obligations already incurred.
15) Dispute Resolution; Governing Law; Venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflicts of law rules. Before filing any action, the parties agree to attempt in good faith to resolve disputes through non-binding mediation in Maricopa County, Arizona. If a dispute is not resolved through mediation, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona.
16) Non-Disparagement
You agree not to make public statements that are knowingly false or misleading about the Company or our Offerings. This section does not limit truthful statements required by law.
17) Electronic Communications; Notices
By using the website or purchasing an Offering, you consent to receive electronic communications from us. Legal notices may be sent to hello@themamascape.com and are deemed given when received by our mail server.
18) Affiliate Disclosure
We may include affiliate links and may earn commissions if you purchase through them, at no additional cost to you. We disclaim liability arising from your purchases via affiliate links.
19) Privacy Policy
Your use of the website and Offerings is also governed by our Privacy Policy. By using our website, you consent to the Privacy Policy and these Terms, which together constitute the entire agreement between you and the Company.
20) Severability; No Waiver; Assignment
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver. You may not assign your rights or obligations without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.

California residents also have the option to request a full deletion of their account and any data We have collected and associated with them.
We agree to comply with any data request or deletion made pursuant to the CCPA in a reasonable timeframe, during normal business hours and excluding holidays or Our pre-scheduled time off.
Newsletter Privacy
We offer the opportunity for You to volunteer certain information to Us that is used for email and marketing purposes. This information includes, but is not limited to, Your name and email. You will have an opportunity to unsubscribe from any future communications via email, but We reserve the right to maintain a database of past email subscribers. We reserve the right to use this information as reasonably necessary in Our business and as provided by law. Your information will be shared with reasonably necessary parties for the ordinary course of conducting Our business, such as through Facebook ads or Google Pay Per Click marketing campaigns.
